NFL Claims Rights to Saints’ “Who Dat?”

For decades, New Orleans Saints fans have belted out a cheer that has become part of their identity as much as crawfish and Burbon Street: “Who Dat Say Dey Gonna Beat Dem Saints? Who Dat? Who Dat?”

The National Football League, however, asserted rights to the phrase “Who Dat?” earlier this week through the Florida Department of State, not without confusion and outrage from Saints fans, and has issued cease-and-desist orders against New Orleans vendors who sell Saints memorabilia adorned with the wording.  The NFL asserts that the public will be confused into believing the memorabilia is sponsored by the NFL. The NFL further clarified that it is only seeking the rights to the phrase in relation to the Saints, and not as a whole.

The NFL is essentially claiming rights over “Who Dat,” a simple slang version of “Who’s that?” If a legally-recognizable line in the sand can be drawn between rights to a slang version of a commonly-used phrase, and the commonly-used phrase itself, where should the rights end?

Apple’s iPad Already Facing Possible Legal Trouble

Apple stunned consumers this week with the unveiling of the new, cost-effective iPad. The device resembles a larger version of the iPhone, but contains more computer-like capabilities than the popular phone. The iPad name, however, could already cause legal troubles for Apple. A unit of Fujitsu, Ltd. claims to have a trademark on the brand, and issued a statement Wednesday saying it was reviewing its options with legal counsel.

Conan O’Brien’s Comedy Characters Caught Up in “Late Night” Drama

Conan O’ Brien isn’t the only NBC “character” to get caught up in all the late night drama. Throughout his 17 years at NBC, Conan has made much of his fortune off of his famous comedy characters, including the well-known Triumph the Insult Comic Dog.  NBC Universal, however, states that they own the rights to these characters and will likely force them to stay behind while Conan departs to another network.

Start of the Year Legal Needs

Whether you realize it or not, the start of a new year is an important time for business owners.  Annual reports and tax returns are coming due.   There is no better time to meet with your business law attorneys for a general consultation.

  11. Reassessment of the value of any buildings, offices, land or real property owned to that your property taxes reflect today’s market value, not yesterday’s inflated values; and,
  12. Assessing your business’s need for capital – (i.e. – would the future of your business be better served with a loan or investment from the sale of stock or other interest in the business?).

Broward County moves to the online sales in March, and Miami-Dade started earlier this month.

The counties say they’ll save time and money as they face budget cuts and a ton of mortgage defaults.

Apple Continues “Me-Too” Strategy in Patent Battle with Nokia

Apple has filed a complaint with the ITC (International Trade Commission) requesting a ban on imports of Nokia mobile phones alleged to infringe on Apple patents. If the scenario sounds familiar it’s because it follows Nokia’s request that the ITC ban imports of Apple devices alleged to infringe on Nokia patents.

Hilton execs accused of corporate espionage

As the hotel industry continues to struggle in a weak market, Starwood Hotels has upped the ante in its fight against rival hotel giant Hilton Worldwide with yesterday’s filing of a new, 86-page court filing against Hilton in the U.S. Southern District of New York.

The new filing claims that top officials of Blackstone-owned Hilton - including Hilton Worldwide CEO Christopher Nassetta, Hilton’s global development chief Steven Goldman and “at least five of the 10 members” of Hilton’s executive committee – knew that Hilton possessed Starwood’s confidential material.

Kodak Sues iPhone, Blackberry Makers for Patent Infringement

In a suit filed with the U.S. International Trade Commission (ITC), Kodak claims the iPhone and camera-equipped BlackBerry models infringe a Kodak patent that covers technology related to a method of previewing images.
